A young man was arrested for DUI. Attorney Cabe took the case, and filed various pre-trial motions. Despite warnings of shaky appealable issues regarding improper evidence, the court denied the motions. Nevertheless, at trial, the arresting officer testified to matters that are not admissible in front of the jury. Mr. Cabe objected, and requested a mistrial. As the Court retired to chambers in effort to contemplate the witness’ error, Mr. Cabe saw an opportunity. With his client’s permission, he presented the prosecutor an alternative plea deal that would result in waiving potential appeal rights in exchange for a plea deal. The prosecutor agreed, and the DUI was reduced to reckless driving.
